I dislike repetitious presumption. Okay, so Spooner is a radical for his time, I grant you. But reaching for repetition as a hammer to make your point destroys any sympathy from your audience. A great read and a book that provides loads of details on the subject at hand. I still read this book over and over.
This essay entails a thrilling and exciting look into the debate on slavery in the pre-Civil War era. Lysander held a rather unique political position in the time because he was opposed to slavery AND the Civil War. Spooner was a Natural Law theorist who once sued the State of MA bar to allow legal apprentices the same Bar priveleges as Lawyers that went to school. He also started a Post Office to compete with the USPS that was such a great threat to the Postal Service that congress returned to the 3 cent stamp.
Lysander's argument, which is so intricately laid out in this essay that its practically a syllogism, is basically that despite references to slavery within the constitution itself the principles that were laid out and passed into law by the ratification of the constitution and the bill of rights, in principle, abolished slavery. But keep in mind that this did not mean that Lysander was a fan of the constitution taking the position that the Constitution has either authorized the government that exists or has failed to prevent it and in either case it is unfit to rule over a free people.
Lysander Spooner attempts to show that slavery is unconstitutional and always had been so. He starts by implying that immoral laws are null and void. Try violating an immoral law and see what happens. He then tries to say that slavery was added as an amendment to state constitutions. He then argues that the plain meaning of the words in the Constitution does not apply to slavery. The use of the words "free men" does not mean (as opposed to slaves). His thesis stands logic on its head. When any state with slaves prepared to join the union, did anyone say "You can't join the union. It is free." He ignores the debates of the time where some wished to ban slavery. The substance in the debates disproving his contentions, he declares irrelevant. He acts as if the Constitution must give the states permission to have slaves. He ignores the whole body of law since the Constitution. The idea that the slave owners submitted to the elimination of slavery is preposterous. He and his fellow abolitionists should have said "Slavery is odious and evil and constitutional. It shouldn't be." He is right in stating that immoral laws are wrong. He should have let it go at that.
